Terms of Use
These terms cover your use of the Ja-Lee portal at portal.ja-lee.com and the Ja-Lee Mapper iPhone app (together, “the portal”), which are run by Ja-Lee (“we”, “us”). By signing in or using the portal you agree to them. If you use it on behalf of a business, such as a contracting company, you agree to them for that business too. Our Privacy Policy explains how we handle your information, and our public website, ja-lee.com, has its own terms.
The portal isn’t for emergencies. For a gas smell, fire, flooding, sparking electrics or anything else that could hurt someone, leave if you need to and call 911 or your utility company first. Then let us know.
Your account
- Homeowner accounts are set up by invitation from Ja-Lee. Contractors may register for an account.
- You must be at least 18 and able to enter into these terms, and the information you give us must be accurate and kept up to date.
- Keep your password to yourself and don’t share your account. You’re responsible for what happens under it. If you think someone else has used it, change your password and tell us straight away.
- We may suspend or close an account that breaks these terms, puts others at risk, or is no longer needed for our work together. We’ll tell you why unless the law or someone’s safety prevents it.
What the portal is for
The portal helps homeowners, Ja-Lee and contractors look after homes and get repairs done: keeping a record of each home’s rooms and fixtures, asking for and tracking repairs, sharing photos and files, messaging about jobs, and arranging estimates and visits.
Repair work, estimates and payments
The portal is a way to arrange and keep track of work; it doesn’t set the terms of that work. The work itself, its price and how it’s paid for are governed by the estimate you accept and any separate agreement with Ja-Lee, and contractors’ work for Ja-Lee by their own agreements with us.
The portal doesn’t currently take payments. The estimates, deposits, balances and payouts it shows are records for information; what you owe or are owed is set by those agreements.
What you share
- You keep ownership of the photos, scans, floor plans, descriptions and messages you add to the portal.
- You give Ja-Lee permission to store, copy, display and use them, and to share them with the people working on your home, as needed to provide our services and run the portal. That permission continues for as long as we keep them under our Privacy Policy.
- Only upload what you have the right to share. Please avoid capturing other people, or private information that has nothing to do with the work, in photos and scans.
- Don’t send passwords, payment card numbers or Social Security numbers through the portal’s messages.
Using the portal fairly
Please don’t:
- use the portal for anything illegal, harmful, fraudulent or abusive, or to harass anyone;
- try to see or change information that isn’t yours, or get around the portal’s security, sign-in checks or limits;
- upload anything harmful, such as malware;
- copy the portal’s data with automated tools, or overload or interfere with it; or
- copy, take apart or reverse-engineer the portal or the app, except where the law allows it.
The Ja-Lee Mapper app
The app measures rooms with your iPhone’s camera and sensors. Scanned sizes are close but approximate, so check them with a tape or laser measure before ordering anything made to measure, such as blinds, windows or flooring. The portal’s item notes show where each size came from.
Our portal and name
The portal, the app, their design and the Ja-Lee name and logo belong to us. These terms give you permission to use them as intended while you have an account, and nothing more.
Availability and changes
We work to keep the portal available and your information safe, but we may need to change, pause or stop parts of it, for example for maintenance or improvements. We’ll try to give notice of significant changes.
Ending your use
You can stop using the portal at any time and ask us to close your account by emailing [email protected]. If your account closes, the parts of these terms that by their nature should continue, such as those about what you’ve shared, disclaimers, liability and governing law, keep applying.
Disclaimer
The portal is provided “as is” and “as available”. To the extent the law allows, we make no promises or warranties about it, express or implied, including that it will always be available or error-free, or that measurements and other information in it are exact. This section is about the portal itself; repair work is covered by the agreements described above.
Limitation of liability
To the extent the law allows, Ja-Lee won’t be liable for any indirect, incidental, special or consequential loss arising from your use of the portal, and our total liability for claims about the portal itself is limited to US$100. Claims about repair work are governed by the agreement for that work. Nothing in these terms limits any liability that the law doesn’t allow us to limit.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute about them or the portal will be heard in the state or federal courts located in Westchester County, New York, and you and we agree to those courts’ jurisdiction.
Changes to these terms
We may update these terms from time to time. We’ll post the new version here and change the date at the top, and tell you in the portal or by email before a significant change takes effect. If you keep using the portal after that, you accept the updated terms.
